In the first suit, YSL was sued for $1million in damages in April of 2011, when YSL’s shoe caused confusion as being Louboutin shoe. Christian Louboutin had a trademark granted to him in 2008. The trademark stated that Louboutin has the exclusive right to make red-soled shoes for“women’s high fashion designer footwear.”
When the case came to U.S. District Judge Victor Marrero, he questioned that the trademark was “overly broad.” The YSL team agreed with that statement and said, “No designer should be able to monopolize a color in fashion.”
The Judge postponed the decision, but later decided that christian louboutin sale is entitled to a trademark on red soles, except when the rest of the shoe is red.
Judge Cabranes said that he believes that Louboutin will return to the case, wanting a trademark on monochrome shoes.
